Where to apply
A superior official; the prosecutor's office; the court; the Commissioner for Human Rights (Ombudsman). Under article 358 of the Criminal Procedure Code, complaints about the acts and decisions of an investigator go to the head of the investigation unit and to the prosecutor who supervises compliance with the law in the investigation. A complaint about a prosecutor goes to a higher prosecutor. Article 27 guarantees the right to complain about the procedural acts of the inquiry officer, the investigator, the prosecutor and the court.
What the complaint must contain
The date, time and place of the event; the surname, position or service card number of the officer; what happened; which right was broken; your specific demand; the evidence.
Collect evidence
The details of witnesses; a medical report (if there was physical force); a video recording; copies of documents; the summons.
If there is no answer
Under article 40 of the Constitution, complaints must be considered in the order and within the time limits the law sets. No answer is a failure to act: under article 55 you may complain to a court about the failure of an official to act. Apply to the higher body as well.
