How do you pay and appeal a traffic fine?

You pay a fine for a breach of the traffic rules within sixty days from the day of the decision. If you do not agree, you can appeal the decision to a higher body or to court. You file the appeal within ten days from the day you received a copy of the decision.

Payment

Under article 332 of the Code on Administrative Responsibility, a fine for a breach of the traffic rules is paid to the relevant bank institution not later than sixty days from the day the decision was made. If the decision is appealed — not later than thirty days from the day of the notice that the appeal was not satisfied. Keep the receipt: the database can update with a delay.

If you pay fifty percent of the fine within fifteen days from the day the decision was handed to you, or seventy percent within thirty days, the rest is not recovered (article 332¹). This procedure does not apply when the decision is appealed, when the offence is repeated within one year, and for the offences under articles 131, 132, 136 and 140 of the Code.

Appeal

Under article 315 of the Code, the decision is appealed to a higher body (official) or to the district (city) criminal court. The person who files the appeal does not pay the state duty. State the following in the appeal:

The time limit

You file the appeal within ten days from the day you received a copy of the decision (article 316). The body that hears the appeal can restore a time limit missed for a valid reason. If the fine is not paid in time, the decision goes to enforced execution.

Advice

When a camera records the offence, the owner of the vehicle, or the person who used it on a civil-law basis in the established procedure, carries the liability (article 17¹). If the hearing of the appeal establishes that another person held the vehicle at the moment of the recording, the owner is released from liability. Prove this with documents.
