What rights does a child have?

A child has the right to live and grow up in a family, to know the parents and talk with them, to express an opinion, to have a name and a surname, and to own property. Under article 68 of the Family Code, the child's opinion counts at any age.

The opinion of the child

Under article 68 of the Family Code, a child can express an opinion on any question that touches his interests. The bodies that make the decision must consider the opinion of the child at any age. A change of the name or the surname of a child who is ten years old, and the adoption of such a child, are possible only with his consent.

Property rights

A child has the right to maintenance from the parents and to own the property that comes to him. The parents do not become the owners of the property of the child automatically.

Protection

Under article 67 of the Family Code, when the rights of a child are infringed, the child can apply to the guardianship and trusteeship body, and from fourteen years of age to the court alone.
