How is registration at the place of residence arranged?

Article 32 of the Constitution guarantees freedom of movement and the choice of the place of stay and residence, except for the restrictions the law sets. Registration at the place of residence or stay carries a state duty. Living without registration brings a fine of three base calculation amounts (BHM).

The constitutional basis

Under article 32 of the Constitution, everyone who is on the territory of Uzbekistan on legal grounds has the right to move freely around the country and to choose the place of stay and residence. Only the law may set restrictions.

Permanent and temporary

The law separates registration at the place of residence (permanent) from registration at the place of stay (temporary). Under article 5 of the Law on State Duty, a state duty is charged for both. The duty is paid before the relevant documents are issued (article 22).

The documents you need

As a rule you need an identity document, a document of title to the housing or the consent of the owner, and an application. Ask the registering body for the exact list in advance.

Living without registration

Under article 223 of the Code on Administrative Liability, living without registration at the place of residence or the place of stay brings a fine of three base calculation amounts (BHM). A repeat within one year brings a fine of five. A person who allows another person to live in their home without registration is also fined five base calculation amounts. Persons under eighteen and over sixty are not held liable under this article.

If you are refused

Ask for the refusal in writing. Under article 40 of the Constitution, you may complain to a higher body. Under article 27 of the Code on Administrative Court Proceedings, a decision of a state body can also be challenged in the administrative court.
