The documents you need
Before construction you need: the title document for the land plot; the architectural and planning assignment; the design documents approved on the basis of a positive expert opinion; the other documents set by the legislation.
The procedure
Under article 31 of the Urban Planning Code, construction work goes ahead after the client notifies the territorial inspectorate about the start of the construction and installation work. The work follows the urban planning documents approved on the basis of a positive opinion of the expert organisations. Ask the authorised body in advance about the application procedure and the time limits.
Construction without a permit
Under article 212 of the Civil Code, an object built without the required permit is an unauthorised construction. The person who built it does not get ownership of it: he cannot sell it, give it away or let it. On the claim of a person whose rights are infringed, or of a state body, the court orders that person to demolish the building, or to pay for the demolition. There is one exception: the court can recognise the ownership of the building for the owner of the land plot, if the building does not infringe the rights of other persons and does not endanger life and health.
A refusal
If a decision of an administrative body infringes your rights, you can file an application (complaint) against it with the administrative court.
