Can you work a second job?

Huquqchi legal team

Yes. Under article 432 of the Labour Code, a worker can take a second job with another employer, or at the main workplace, in the time free from the main work. The parties sign a separate employment contract. Pay follows the time worked, the output, or other terms in the contract.

Two kinds

An internal second job — at the main workplace. An external second job — with another employer.

How it is set up

Under article 435 of the Labour Code, the parties sign a separate employment contract, and the employer issues an order. The contract must state that the work is a second job.

Limits

Under article 433 of the Labour Code, a second job is not allowed: for persons under eighteen years of age; on work with unfavourable conditions, if the main work has the same conditions (health system workers are an exception); in the other cases that the legislation gives.

Leave

A second job also carries leave. Under article 439 of the Labour Code, it is given at the same time as the annual leave at the main workplace.
