How is an apartment building managed?

An apartment building is managed by the owners themselves, by a homeowners association, or by a management organisation. The general meeting of owners picks the method. The common property belongs to all owners in shared ownership. The general meeting also sets the amount of the mandatory contributions.

Common property

The stairways, the lifts, the roof, the basement and the engineering networks inside the building belong to all owners of premises in shared ownership (article 124 of the Housing Code). All owners have an equal right to use the land plot next to the building.

Taking decisions

Under article 138 of the Housing Code, the general meeting of owners decides the method of management of the building. The contract with a management organisation, and, when the owners manage the building directly, the maintenance and repair contracts, are also made on the basis of a decision of the general meeting. The general meeting also sets the amount of the mandatory contributions. The minutes of the meeting are the main document.

Contributions

The costs of keeping the common property are shared between the owners in proportion to the area of their premises. If you do not use your premises, this does not free you from these costs. If the contract says nothing else, the management organisation reports to the owners on the performance of the contract for the past year every year, within the first quarter.

If a dispute starts

Housing disputes are settled by the court. Control over the use and the preservation of the housing stock belongs to the local hokimiyat (the local government office), so you can also apply to it.
