The main rule
Under article 245 of the Labour Code, the monthly pay of an employee who worked the monthly norm of working time and performed the labour function under the contract cannot be lower than the minimum wage that is set.
What counts and what does not
The minimum wage does not include bonuses, supplements and other incentive payments, pay for overtime work, pay for work on rest days and holidays, pay for night work, district coefficients, and other compensation and social payments — the employer pays these on top.
Part-time working hours
With part-time working hours, the pay is in proportion to the time worked or depends on the output (article 258). There is also a minimum hourly rate: it must be not lower than the monthly minimum divided by the average monthly number of working hours for a six-day working week (article 245).
If the rule is broken
If your wage is below the minimum, give the employer a written application. Under article 545 of the Labour Code, you can choose to apply to the labour disputes commission or directly to the court. The State Labour Inspectorate supervises compliance with the labour legislation.
